sorry kenta wrong answer.
I suspect you're trying to be whimsical but when you sit behind the wheel you and only you are responsible for the consequences.
Pedestrians do not have to get out of your way even if it is a group drive.

I did look at the board and was interested to note that no discussions of a group drive were posted even though at least 2 forum members were present.
I would hope that their moderators were not stupid enough to have deleted any related thread since that would be deliberate destruction of evidence...

i agree with you jerry and as mom used to say "but for the grace of god" that has not happened to anyone here during a group drive

we've all driven like that before and the group drives tend to promote a bit of reckless driving as part of maybe peer pressure- i can see why some folks now avoid these drives

i feel sorry for the victim's family and the driver should be held responsible for his actions

Sad for sure.

From the forum: There are 2 sides to every story,

1) Dave was driving the speed limit while some elderly lady jay-walked and ended up being run over. In this case he is innocent.

2) Dave was showing off and driving 70mph in residential areas while losing control and accidently hitting an old lady.



The woman was 54....not quite old lady status. Pedestrians often don't cross the road safely, or think to wear light colored clothing at night. Accidents do happen and the driver bears the brunt of the responsibility, if speeding is a factor, even more so. Accident reconstruction will likely tell just how fast he was going.

Thats makes our conversations about the subjectof group drives last summer all the more important. Bill raised a lot of valid points, wont get into them but its something we should not sweep under the rug every time it comes up for discussion.

As far as that incident that this thread is about, its interesting that Daves lawyer was in the car following him and what he has to say is read worthy. wonder how this one will turn out.

Dave - Bill's insurance only protects the organizers NOT the drivers or anyone on the drive - even still EVERYONE can and will be sued in a case like this

so if you think you or anyone else are immune to being sued or protected while on a group drive and breaking the law (ie speeding, reckless etc etc) please confirm with Bill what the insurance actually covers

actually it would be nice to see the policy given the fact that nes2ko paid for it (THIS IS NOT A bash on nes2ko!!! paid members should understand what the policy actually is and how to obtain coverage )

Steve I said valid points, I did not say anything about insurance!

My post says nothing about my views on ins protection.
There was a lot more discussed last summer besides insurance.

Like I stated Im not going to discuss it here, its just something to think about.

Fact is a pedestrian was killed. My guess just like a rear end collision or a single car accident, the driver is at fault. It was an accident, but one with a tragic outcome. The final charges and what happens to the driver will likely be determined if he is found to be reckless. If reckless, the guy is likely going to jail.

My understanding about the insurance is that it protects the organizers only. Hope this young driver had plenty of insurance on his car as for sure there will be a civil suit as well.
