Default Fighting Speeding Ticket

Hey Everyone,

I am going to court to fight a speeding ticket.

Rt3 Northbound in Plymouth.

I did tons of research and found out the speed limit is illegally posted. The state did not follow the recommended traffic study. The study recommended 70 mph.

Also, the officer must observe a speed violation over 1/4 miles. This was not possible b/c of the curve in the road.

Lastly I have requested proof that the laser devise was working and the officers using it were trained properly. Not of this was provided to me. (Under the freedom of information act, the state must comply with documentation request with-in 10 days)

I'd like to hear how you make out.

As far as the state not posting the recommended limit, do we have any roads in MA with a speed limit over 65?

Should be an interesting hearing. How fast were you going?

The citation is for over 80.

It is very strange but I have found tons of illegal speed limits in MASS.

Many are in Newton.

James - honestly i don't think you have a chance by using the fact that a recommended traffic study says 70 mph should be the limit because the speed limit on Mass highways is 65 MPH nor do i think the judge will look favorable on your case because you did not receive the requested proof that the laser devise was working and the officers using it were trained properly.

What I do think will happen is that the Judge will look at your record and make a determination based on your driving history

You may be able to postpone it with a continuance though.....the goal there being that the cop forgets to come to another court date.

The Commonwealth charges $20.00 to appeal your own ticket to the judge.

Thanks for your input.

Bass, I have a clean record no moving violations in the last 20 yrs.

I will give you guys a follow-up on Tuesday after I appear before the magistrate.

i would try to get a postponed date... if the cop doesnt show then you get out no charge right?
also, even if you have to go in court and fight it, you will probably be taken a little easier on since you have a clean record

I have a friend who beat a ticket because the cop used a device that hadn't been inspected and adjust according to the sticker dated on it. But that was in PA.
