You're forgetting the part where the seller might not have known anything was wrong and isn't responsible. He sold an used item "as is", if something is wrong how is he suppose to know that it wasn't the buyer's fault? It sucks to be in situations like this, but sometimes those are the risks involved.

Explain what that proves? It's still his word against the buyer's word. How is the seller suppose to know if the diff wasn't destroyed/damaged by the buyer?

Because its not that easy to destroy a diff where all you did was bolt it up. Its not like he cracked it open, installed the gears, blah blah, blah. With the amount of scamming going on here, I wouldnt be surprised if the seller tried to pull a fast one. However, its all speculation. This all comes down to the reputation of the members in their local communities. The buyer apparently knows how to bolt/unbolt a diff from the car, and Im sure bill can determine if the diff failed due to install error, or it was busted from the get/go.

Thank you NFR, I'm glad someone see's it my way.

But, that's not to say that I don't hear what you other guys are saying. I understand completely, and I would feel really bad and do everything in my power to make the situation right if I'm wrong, but there are just some certain incriminating facts that just lead me to beleive other.

But, that's why I want to have it checked out. Billman, I understand you're busy but PLEASE pm me back!

Buyer pays bill a price, which bill can give him an invoice for. If bill determines the diff was busted from the get go, seller refunds $1300 + Bills price.

I guess it could be done with Paypal, COD, whatever.

Fact is, when I take it apart it will be bad. There is no way to tell if it was like that before or after the install.

Can just bolting up an enclosed diff (much like the ones you order from Rick with 4.57s) really shear the guts of it?
