Traffic Ticket Question
Can anyone tell me if there are any points applied for violation of Section 1229-c? I got my ticket back and the fine is $100, the violation item is listed as "Seat belt violation" on the schedule of fines that they sent me. TIA

Is a seat belt violation considered a moving violation? I'm from NJ and got stopped in NY for speeding, 83 in a 55, and the trooper automatically instead of writing me up for speeding wrote the ticket up as a seat belt violation even though I was wearing a seat belt. Six months later after pleading guilty the fine just now showed up. Is it going to be reported to NJ? I'm sure my insurance company will find out about it and increase my rates.

Logically you would think that a seat belt is a moving violation. If the car is parked and you don't have your seat belt on how can he give you a ticket?
BTW, I guess there are no points attached to it but it is still considered a violation. http://www.troopers.state.ny.us/Publicatio...fs/pointscd.pdf

Although I am not arguing with anyone...
I remember 2 cops telling me that seatbelts are no points (dont know if I believe them)...and friends getting 2 of them, and got no points.
Although Dan, you are right, you cant really get a seatbelt ticket while parked, I dont think it is considered a "moving" violation. I have to go to the DMV tomorrow to postpone my courtdate, so I will find out for you John.

Dave it's no points, I found the listing on the state website that's why I listed it in a later post. But it is considered a moving violation I think, because it did show up on my insurance this year.
