Default 1st time pulled over

Hey guys, just have a question. I got pulled over making an illegal U-turn last night on a parkway near campus (which the entire length of the road there are multiple points where they are legal). I was leaving a bar and grill that was right near the light and I missed the sign since I was looking to avoid/watch for traffic as I crossed 2 lanes of traffic to get to the turn lane.

Got pulled over and asked if I had any to drink, I had a 2 pints with my food while I was there for 2 hours. Im sure I had no signs or indications of drinking, being buzzed, drunk etc. He leaves, comes back and asks me to step out of the car. Gives me field a couple field sobriety tests (on the side of this 4 lane parkway), then I get the Breathalyzer. He looks to his partner and shows him, they both shrug their shoulders and have that "meh" look on them. I had clearly passed all their tests. Goes "we're not going to arrest you, you can go back into your vehicle", comes back gives me my ticket and were done.

My question is, do cops have the right to field test and breathalyze anybody they please at any time? Can they only do it if you admit to having drinks? Somebody also told me they can only do it if you are visibly influenced by alcohol.

I wasn't too nervous, I knew I would pass everything. With my job in particular and with many other hospitals a DUI/DWI can get you the axe. Anybody else got any good stories about being pulled over?

If they think you've been drinking then yes they can make you do the tests. The good news is, if you have nothing to worry about then its no big deal.

I got my hand slapped by a security guard for getting sideways in the Circuit City parking lot at 11 at night. sorry mister, I promise i'll be good.

depends on your state law. You may be able to refuse to take a breathalyzer, but if there is suspicion of driving under the influence, you can be arrested regardless. Refusal to take one will also show consciousness of guilt which is permissible as evidence in court. In other states, the act of getting a drivers license and driving is deemed consent to submit to a breathalyzer.

I was told that even if you refuse to take a breathalyzer on the side of the road and you are then taken in, they can test you at the station regardless of what you say.

Even if you blow over on the road they will test you with the serious machine at the station. The reason why they have a 12 hour suspension with no further consequence in some areas is that you are drunk enough to not drive, but not drunk enough to actually register a DUI on the main detection equipment back at the station. Or so I've been told...

What the hell does that mean? If I am under the legal limit, I am legal to drive. How can you be too drunk to drive if you are legal? If I am less than .08 in Ohio, I have committed no offense, even if at .075 and am deemed by the state as safe to drive.

BTW, refusal of a Breathalyzer test in Ohio results in an automatic suspension of your driver's license.
