I see, different rules for different schools. Makes sense, especially since there is no other penalty. Probably wouldn't have been a bad way to go instead of the drop from .10 to .08 that happened in most areas.

they can either do a test by breathalizer or by doing a blood test at the station. thats the choices here in cali. and yes if they have suspicion of dui, they can do either one. your choice.

I got pulled over in college doing 110 around midnight coming off a long straight freeway access ramp from a downtown area and onto the expressway. Cop pulled me over told me to get out and follow his pen with my eyes.

I said to the officer, "I don't mean any disrespect but I have not had one drop of alcohol."

HE asked me what was going on and off the top of my head I made up this lie: "I was trying to get out of uptown and there was a low rider with what looked to be a bunch of gang bangers in it. They were yelling stuff at me and I was trying to ignore them. At the final stoplight before the ramp one threw something out the window that hit my car and I gave them the finger. The doors opened up and thee guys came out of the car towards me, the light turned green and I split, fast. I am actually very relieved to see you officer."

(Actually my turbo had just been replaced and I was testing it out.)

He told me to get back in the car, go straight home, and wear my seatbelt this time.

They probably saw you come out of the bar, they park near and wait. When you made the illegal u-turn, you gave them justification to pull you over and with that they look for tother things. Especially alcohol around holidays (Cinco de Mayo). If you would have had a joint sitting in the ash tray they could see, you would of had drug charges. They do this ALL the time. Watch COPS (TV show) Thats why they pull over people for a light being out or not signaling on a turn. They hope it leads to other charges.

Haha yea, i learned my lesson. Crappy part is that I didn't even realize it, its not like I ignored it. Thats life though.

You admitted to having alcohol.... that all it takes.

Think about it.... the majority of people who are pulled over are ALWAYS going to lie about the amount they have consumed....

Police have to assume the worst, so the breathalizer was warranted IMO.

Consider yourself lucky your blow was with in limits.

yeah, but if you know you're not drunk (and you know), and you have had drinks, lie to them, then they test you anyway and discover alcohol, they're going to be PISSED and probably add as many charges as they can. tell the cops the truth.

one time i got pulled over...i was leaving a movie theater, turned onto the main road, and about 100 yards later got pulled by a trooper. 100 yards in a 91 accord, not even enough to get up to the speed limit. so i'm thinking wtf...anyway i stop, he comes over and says "i pulled you over because you're swerving, look like you may have been drinking." ok first i was 19 years old, leaving a movie theater. really? i'm drunk? ok...so he shines the light around for about 30 seconds, looks at me, can tell obviously that i'm not drunk, so he keeps shining the light around, til he finds something: i'm in a '91 accord, which has an automatic shoulder belt and a manual lap belt, which i haven't fastened yet.

officer: wanna tell me why you're not wearing your seat belt?
me: yeah i just haven't fastened it yet, i just pulled out of that (pointing) parking lot.
officer: yeah why don't you come back to my car with me
me: (in my head) are you f'ing kidding me?

one of the few examples of an asshole cop, just looking for a reason to give a ticket...oh well

admitting to the alcohol I figured has you dead to rights and totally open to what they see fit.

another story, a friend of mine (cute girl) got pulled over going through a red light after leaving a bar right down the road from campus. She had 4 pints over the course of the night in her and is a small asian girl. All she got was a ticket. She got so lucky she didn't get into an accident, asked to step out the car, arrested etc.

idk if i consider myself lucky, if I had 4 or 5 and blew legal that would be lucky. Mine was just being smart enough and having self control to have some moderation Its hard to do when the people you go with can just throw them back and have 4 or 5 easily.
