The person at fault has to pay their deductible no matter what, but they are still liable for your entire bill so I'm not sure what you mean here...
If you damaged another drivers car which is a POS.... and it's a no-fault state, then if he goes through his insurance, he will have to pay his deductable when filing his claim that it is YOUR fault. He would pay his $500 deductable and wait for your insurance to pay for the damage.

If your insurance company deems that the damage to his car is only $500 then in order to get the money he would have to take it to get fixed and if he's driving a POS, he may not care about a ding and just want cash.

In essence on a small level accident, he would be paying for his own repairs.

YOU on the other hand have to pay YOUR deductable of say $1000, then your insurance won't even settle. They will have YOU pay for it anyway. So why file an accident claim and put it on record?

This is not ALWAYS the case, I'm just explaining how it works sometimes.

The first thing you should do ALWAYS is write down and/or take a picture of the other car's license plate number in case he decides to dip.

[QUOTE=X4DLuvOfSpeedX,Nov 29 2005, 01:13 PM] Always always always get a police report when you're not at fault, even for the smallest fender bender (we all know that a fender bender nowadays can mean an easy $1K in repairs).
