Default Car got stolen, return damaged, thieves caught, ho

My gf was car jacked by 3 guys last week. They blocked her car and pointed a gun at my gf and took her car. The car was found 4 days later but had significance damanges, blown engine, all glasses were broken, ripped interiors. We only have liability insurance on the car. The 3 thieves were caught 2 days after the car was found. They admitted to stole the car along with stealing 4 more. One of them was only 15, others may be similar age.

Now how do we go to sue them for the damages they costed? The car probably valued at $7000, they also took a labtop in the car along with school books, clothes and other goods. Right now we have no idea how to get compensation for our losts. Do I need a lawyer, I don't really want to get one since the lawyer's fee is pretty high. Any advices? I'm in Georgia, btw.

Very sorry to hear that. Unfortunately you are going to get to know the old saying "You can't get blood out of a turnip" pretty good.

I would go after them to the full extent you can, but you will find that no one at the police department or prosecutors office to be of much help at all.


The best advice: Always insure what you can not afford to replace.

Sorry I don't have better news. Good luck, I hope you get her cash out of them.

i would probably consider paying to have someone crippled, if they'd pointed a gun at my fiance. 15 or not.

Talk to the DA that is prosecuting the case. Most thieves are ordered to pay restitution, also ask the DA for the max sentence.

Usually small claims only allows $5k but it might be higher in your state. Your juristicion might have a higher limit of 10k.
Since they are going to plead guilty to the charges you have an open and shut case. Every year your going to have to renew the judgemnt aginst them and when they get a job you might be able to garnish their wages. You can get a lawyer if your willing to pay the price or my suggestion would be to go to small claims and get the max amount you can and renew the judgement every year until you can garnish their wages due to lack of payment. Also the jusge will, if your present at the criminal procedings, make them pay resitution to you. That's the best way period. Also if your income is very low most local police departments have a victoms compensation fund that is usually made from donations from you neighbors. Look into all of these options very carefully, talk to the DA about getting the judge to give you resitution for their crimes.

That's fscked up... must have been traumatic for your girlfriend...

When I was in college, my car was involved in a theft. The stupid jerkoffs (who were both 18) tried to steal my wheels. . . which were just stock Acura Integra GS-R wheels. Anyway, they were caught and had to pay me to replace all of the lug nuts and center cap things they tossed out the window while being chased by the cops.

Try getting the judge to order them to pay restitution. Not sure where a 15 year old will get that kind of cash, but its worth a shot.
