I didn't think my first post on s2ki would be this, but here we go. I got FALSELY pulled over today for "speeding." The Illinois State Trooper clocked the Honda Pilot that flew up from behind me like a bat out of hell, proceeded to tailgate me in the S, and decided to pull me over instead. He said he clocked me at 92 mph in a 45 which, in Illinois, is considered a Class A Misdemeanor (criminal offense). I have a pristine driving record so the cop didn't arrest me or tow my car, so I lucked out there. I plan on hiring an attorney to represent me in court. My question is has anyone else been successful in reducing charges down from 40mph+ to a lower offense? What further course of action should I take? I'm in school finishing up my MBA right now and I'm very worried because I need to maintain a clean record for future employment opportunities. Thank you all in advance for your help.

P.S. Since I finally popped my s2ki cherry, I promise to be more active in the forums.

Ouch... Hiring an attorney is your best bet and if he does traffic court all the time, you should be fine.

In the end, the court system listens to the mighty dollar and acceptance that you f@#ked up. Hire an attorney ($$), pay some fines ($$), and take a driving class ($$), you should end up being relatively fine.

Yeah, I have found a really good traffic attorney who is very well respected in the county where the incident took place. I was hoping that this was just going to be one very expensive mishap. I'm just more upset by how I was treated by the officer, I never felt so degraded in my life. Came up to my car screaming with his gun out, let's just say it wasn't pleasant. Thanks again for your input, I appreciate it.

 

Not to sound like a jerk, but why were you driving 92mph in a 45 mph zone? That's just dumb. Maybe 55, even 60mph I get, but 92 mph?! Even if the Honda Pilot was tailgating you you were in front so of course the cop will pull you over instead.

Glad no one got hurt.. Still. 92mph? Cop should have taken away your license

I totally understand where you are coming from, and thanks for your opinion. The whole reason why I need the lawyer is that I was not going 92 mph, my speedo wasn't over 60 mph the entire time. The officer clocked the Pilot as he was flying down the on-ramp behind me, and pinned me with the ticket. I don't know if you are aware of something called racial profiling... I'm half black and half Czech, and I look like I'm about 18-19 years old when in reality I'm 26 going on 27. The cop was about to pull over the Pilot and saw me in front of him (top down), and decided to get me instead. This isn't the first time I had to deal with something like this in regards to Johnny Law, but this is definitely the first time I have ever needed legal counsel. I hope this elucidates things for you a bit.

Trust me, I'm not that a-hole speeding 40 mph + in general, let alone on the 4th of July.

Oh ok my apologies. From your original post it sounded like you admitted going 92 mph.

In that case yes I would fight it. Find a good lawyer. And yes I've had negative experiences with state troopers. I do think they are worse than local cops.

No hard feelings man. Sorry, I was a bit vague with my first post. I would thank all of you guys for your input. I will definitely keep you posted as everything progresses.
