In our newspaper today, it says the deck / porch was built in 1998, but now that they dumped 50+ people on it and it broke, all of the sudden it was built improperly and thus the lawsuits begin.

I am not sure if Chicago inspects rental apartments on an annual (or semi annual) basis, but if they did, then they missed it through all of those inspections..... and if they didn't inspect... well... there is just one more lawsuit.... they should inspect......it is there duty

The fact that it had been there for 5 years with no problems says that the deck was probably ok, but not meant for 10,000lbs!

What a stupid society!

It really sucks that 12-13 people got killed, but jesus... 50+ people on a wooden deck?

This country gets way too litigious. I just heard of someone who was eating inside of a mall and when they took their trash to one of those trash cans that have a spring loaded lid, the lid came back and broke the woman's finger. so, she went to her lawyer and is considering suing either the mall or the can maker. Come on people.....

Too stupid to open a trash can, so sue someone!!!! If I ever find out who the hell the inventor of stairs is.....man.... I have tripped so damned many times.........

Well according to the news here the building owner did not take out a permit to build the deck in the first place. Neither did the builder (probably maintenance employees of the Building owner). That in itself has taken it to the legal department of the city as well. Owners tend to sidestep the permit process in some places because of all the hoops the local agencies make you jump through and the costs involved in getting a permit.

Actually the owner of that property is a very prosperous and responsible owner, his company LG Properties adheres to all inspections and such.

LG Properties isn't a small time property management company here in Illinois. They may have missed on getting the one proper permit (of the many permits the city makes you jump through hoops to get) for the deck, they did schedule all the inspections that the city builders come to, they did pass all inspections, etc.

It seems very peculiar to me that right as soon as the tragedy happened, withing 36 hours, the city tore down the deck without letting LG Properties' engineers and lawyers having a look at the condition of the deck.

Keep in mind these decks were very new, the wood had not sagged, the strutural rigidity was very solid....

The city itself can be held liable for allowing the decks to stay standing (seeing that they came to inspect them year after year, yet there were not permits; no sense of checks and balances), for allowing a party of that size to go on in the outdoors without a permit, and for tearing the deck down too soon.

If any lawsuits should come from this, the party goers should be suing each other. Having too many people on each deck, having multiple kegs on each deck, and party goers jumping up and down to the music (rhythmic resonance) while the decks were overloaded. Idiots I tell you.

I agree with all of this. It seemed damn funny that they pulled the rest of that thing down within hours..... and it appears that chicago does have inspections and they passed it.....

SUE the beer maker!!!!! If it weren't for them, there would not have been a party goddamnit!!!!!

its getting bad in this country when it comes to this %#$!... ya know people sue because they dump hot coffee on their dumbass selves... a trash can lid with a spring that holds about 1lbs of pressure.. i mean come on... get out there... bust your butt and work... make a living the decent and honorable way instead of suing someone because they looked at you wrong... worthless people... piss me off
