Default Civic Totalled: Could Use Advice

Well, my wife just phoned to say that the insurance company totaled the Civic. Here's the story if you missed it:

She said that they'll pay about $6,300 for the car. I looked around on the internet last night and found comparable cars for an average of $7,400. The question is how best to negotiate the higher price from the insurance company.

The accident was the other driver's fault, so his insurance will pay ultimately, but I'll have to deal with our company and they'll deal with his.

Any advice or experience will be greatly welcomed, and appreciated.

Did you have replacement insurance? If you didn't you might be in a bind as they will probably pay blue book only.

Oh ok. Well, then I guess you can hint at emotional distress or recurring pain and they should up their amount. And if you truly feel you are not getting a fair shake you can take them to court.

You can try having your insurance company go after his insurance company for the difference.

You'll probably need photographic proof that your vehicle was better than bluebook average. I doubt any insurance company will pay bluebook "good" or "excellent" without that. But glad to hear you are OK considering the car is totaled, and glad the other driver has insurance. Best o' luck.

There should be some process involved to appeal the offer ... it differs with every insurance company slightly.

For sure, step 1 is to reject the current offer if you're not happy with it. Tell your agent that you believe the car's value is worth more than what the other side is offering or whatever and ask about what the process is to appeal.
