Ok my original post was kinda confusing so i drew a mspaint picture

basically, my neighbors are building a new wall, because they had this old-****ty wooden one.. and we shared it.. so now they want to put up a concrete one.. the thing is, we have to split half the cost.. that's fine.. now where does the wall go? well theoretically, since the thickness of the wall will be 6 inches, it should be 3 inches on their side, 3 inches on our side, right?

ok, so in this picture, the RED lines are the property lines, the gray is the driveway, green is grass..



ok so if u look at that crooked-wall on the very left, that crooked wall belongs to house 1 and house 2 (stupid neighbors).

keep in mind that house 2 was built AFTER the wall on the left was built.

ok so anyway, the contractor that's building the new wall should build it rite down the center of the RED line between my house and stupid neighbor's house right?

BUT, he says there's some crap about how the the wall HAS to be "X" amount of distance from the house...

and that "X" amount extends into our yard.

So now, they want to build the new wall, (pictured in blue) into our yard..


here's the picture of the intial post they setup.. look how much space they're taking up.

so OBVIOUSLY we are NOT going to allow this..

it is NOT OUR fault, that house 2 was built INCORRECTLY in the FIRST place. if the wall has to be "X" distance from the house, then move THEIR HOUSE, NOT Build the wall ALL in our property.

So because house 1 took up house 2's property, house 2 stupidly built the HOUSE, too far to the right, so now they want to take OUR property? does that mean we take house 4's property? (not pictured)

me and my mom are going to have a talk with them 2mrrow.. and if they don't comply, i'll be holding a 6D maglite in one hand and a 22inch machete in the other hand

If they want to build the wall on your property, they may in effect be taking the property from you. Check with your local building department and make sure ALL permits are applied for, also check the local zoning ordinances that cover fences and walls. Sometimes it's better to get the local building officials involved, and this is one of them. You will also need a plat survey. Get your property lines marked CLEARLY.

ok new dillema:

apparently now the contractor is going through some bull****, about how our property line isn't right at the driveway, and the only way to find out where the real property line is to get a surveyer come in and measure the WHOLE street.

so lets say everyone's driveway is "1-foot" off.. does that mean that BECAUSE, house #2 (dumb neighbors) want to build a ****ing wall, we have to tell the entire ****ing street that we're all off by 1 foot?

I hate it when neighbors think they can just intrude upon other people's property. I remember this discussion in my Law of Property class back in college. You should definitely check your city/town records of where your property starts and ends. If they are clearly intruding, you can most likely sue them for trespass. My law professor (who is also a litigation attorney) told us of a story between him and his neighbor where his neighbor installed a really bright light on their property and the light entered my professor's house through the window. He sued the neighbor for trespass (of the light into his house) after he unsuccessfully tried to talk to his neighbor about the issue. The judge ordered his neighbor to remove the light or redirect it.

This is only what I remembered from that class...so no flames please.

It's always best to consult with your legal counsel first.

There should be some markings on your property that the county plans would show. If you can find it, you should be able to determine where the property boundries are. Until then, "just say no".

You could always "sell" the 1 foot they need.......say for your portion of cost of the wall?
