If you knowingly allow them to build the wall on your property-give them use of your land-an easement will be created and you may possibly forfeit the land. Do not allow this. You could clearly define the lines and then build the wall at their cost and then rent them the extra space at $1/year but do not allow them to create an easement. Stop all work and see a lawyer.

Do you want the wall?
If not you can fight it with the setback issue which is the distance required from the house - They can request a variance from the city and most likely they will get it if you offer no resistance. If you own your home you should have received a lot or survey diagram in your closing packet that should have the locations of markers that define your property from your neighbor's, Either way if you do nothing they will get their way eventually. I would march down to the city permitting office and speak to an officer.

no they can't build anything without our permission.. but anyway we resolved the issue... they're just going to build it on the property line.. it wasn't the neighbors being assholes, it was the contractors.
