he sold me a carbon fibre hood that was supposed to be seibon but turns out to be something called "xr8ed lidds" a company that no longer exists... what should i do ?

Did Mr Dush advertise it as a Seibon for an S2000 - if you Google "xr8ed lids" you get taken (pardon the pun) to a Club for the Acura SRX where they are advertising carbon hoods made by "xr8ed lidds" and the threads that you see are all dated 2003 and no mention of S2000's at all. Now, it is possible that "xr8ed lidds" was concurrently (in 2003) making hoods for a number of cars perhaps including the S2000 because there is reference to hoods for an RX8. The fact that this company (from Hamilton Ont., it appears) is now out of business is really a red herring - your bitch is not with them but with the real estate agent Peter who sold it to you as a Seibon. Hard to imagine that he could be confused because it appears from the photos of the RSX hoods on the RSX Club site that there was all kinds of advertising on the underside of the hood identifying that the hood was an"xr8" made hood, which I presume would have been the same on your's (unless of course your vendor or an earlier owner removed that labeling in an attempt to deceive a purchaser). How did you find out that it was an "xr8" hood? Your vendor could have been sold a bill of goods as well and quite innocently sold to you something which he firmly believed to be a Seibon hood. It is hard to know who in the chain was actually the fraudster. If Mr Dush sold it to you as a Seibon and you can prove to him that it is not indeed a Seibon but rather a "xr8" then if he were an honorable realtor concerned about his reputation he should be prepared to take back the hood and repay the purchase price to you. If however he knew it was not a Seibon (even if he'd been sold a bill of goods) and he sold it to you as a Seibon then he has engaged in a fraudulent act and could be sued by you in Small Claims Court for continuing the fraud. The buck has to stop somewhere, and if he knew it wasn't a Seibon when he sold it to you as one, then the buck should stop at him. He may have a claim himself against somebody up the chain of title if he himself was defrauded but he cannot perpetuate the fraud without consequences. It would not look good on his Real Estate License if somebody (you) is suing him for fraud. This might flush him out to either admit the fraud or to at least keep you whole. At the very least you need to confront him with the issue and tell him that you want to be reimbursed because he sold you something other than he represented it to be. Good luck

Post up pics of the hood. Seibon hoods are average quality, chances are just as good as any other hood out there , not better or worse. Lets see how it looks and fits.
