Default Law related question?

Can a cop generally harrass you on private property? Basically it happened to us in Texas, cop pulled behind... checked ID's etc... Was just curious?

If your in plain view, and they believe you are doing something illegal, I believe they can.

Here is an interesting point... So for example (theoretical [sp?]) If you are in your back yard, running around naked, cop catches a glance... surely they can't get you for indecient exposure?? can they?? I think that it is a fine line they are wallking.

Well, if the cop is on public property at the time and he can see you in all your glory, he can nail you for indecent exposure. It's just as if, hypothetically, you were conducting a coke deal in your living room with the curtains wide open and the cop could see the whole thing from the street.

As for checking i.d.'s. Were you parked? Were you in the car? What do you mean by "private property"? Somebody's driveway? The parking lot at the local Dunkin' Doughnuts? Wouldn't surprise me if you were just being harassed, but who knows.

We were parked in a parking lot which was private property, with the engine turned off.

As far as the hypothetical, I could understand about the "coke" thing, but if you were just walking around in the nude in your own home, would'nt that be an invasion of privacy?? I know that I would be pretty pissed off if a cop came knocking on my door cause he caught a glipse through an open window, and tried to write me up for it.... would be on the order of "Go F$ck yourself"!!!

So let me get this straight: if you're on private property and the cop doesn't like the way you look, he can come over and harrass you; however, if someone hits your car on private property, they can't file a report? You can bet your ass that they would write a report if they caught you spanking your kid on private property, but if someone else damages your property, no report.

Actually Sondra, They did write a report when I got hit on private property, but they could not write the guy a ticket for no insurance.
