Looks like "jaywalking", that's what crosswalks are for.
Still, the driver should have been in control of his car to be able to stop, and not go onto the sidewalk.

The car appears to be going 30-40 mph at the time of the hit, which is over the residential speed limit by 5-15. 25 mph should be safe enough to stop in time for anything that comes up in the headlight's vision, except for anything that would jump in at close distance like deers. The driver would be driving even faster before he started to brake, unless he didnt hit the brakes at all..
I dont think the driver can get away with this even with a good lawyer
