Default Misdimeanor marijuana possession (CA)

sigh.

1 - is it true that i basically will get rejected from 99.9% of my jobs based on this.

2 - these guys left it in a drawer in my hotel room. i continually told the cops it wasnt mine but they said since it was in my room im held responsible. do i have a chance in court?

1 - Depends on what kind of job you want.. I've never been asked wether I had a record or not.

2 - Judges don't usually buy the "these guys" arguments.. unless "those guys" fess up

Hmmm... I've only had a criminal/security check done on me once, and that was for my application to Telus Telecommunications for the job of "internal security." I didn't get the job, it was taken by someone eminently more qualified than I, and apart from that, and 35 or so job applications in the past 2 months before I landed my landscaping job, I was never asked about my background. Then again, this IS Canada, and the laws in the US may and probably ARE different

all the applications ive ever filled out just ask if you have any *criminal* convictions.....would that mean only felonys?

No. Criminal convictions can be either felony's or misdemeanors...

I'm not all that hip on the legalization of "recreational drugs", but it's crap like this that really burns me.

It's a hotel room fer crissakes, not an apartment. You would think that it would be difficult to prove that the pot belonged to you, since you did not have it on your person and it is true that any schmuck could have left it there. There are caveats to this, such as no "roaches" in the ashtrays, and when they searched you and your vehicle both turned up clean.

It defies common sense. How did they come about searching the room? That is what I would want to know. I am pretty sure all they needed was the manager's permission. Who found it? Maid service? Is there a possibility that the people who turned you in get a reward of some kind?

(Showing my age with Cheech & Chong slang).

Sorry to hear that. It does depend on what kind of job you are looking at. Are you over or under 18 years old? You can try yourself or with a lawyer to keep it off of your permenant record.

A long shot, and this is a HUGE longshot is that you can go to trial on this misdemeanor and if the cop no shows up then plead not guilty. You then have to do nothing because without a state's witness they can't prove anything.

Since you are only circumstantially guilty (pot was not yours, but was technically your responsibility because laws made to serve the idiot masses end up hurting everyone [sorry for the rant]) prepare a defence of your own or with a lawyer (I know I'm repeating myself, but this is my summation) and then if the cop no shows then you are clear. Either way you'll be pleading not guilty.

didnt know why they specifically mentioned the word criminal

what offensese are civil? just stuff like speeding or what not? low class misdemenors wouldnt fall under civil? just wondering

they should atleast decriminilize (there goes that criminal word again so i guess it encompasses misdemenors too) mj if not legalize...

oh well when will they learn
