Well, I called the local PD and they basically told me unless someone SAW him put it in her drink, it's his word against hers, and nothing is really going to happen.

In light of that, she didn't end up going in, on the slight chance they would find trace amounts of marijuana from a couple weeks back and would turn things around on her.

I talked to her, a friend who was with her, AND the bartender. It's obvious she was slipped something. She still feels pretty drunk at midnight tonight.

This happened at a family owned place in a nice area. Guess there are more creeps out there than I used to think.

Hmm, sounds like a great way to get sued for slander/libel. If you can't prove it, it didn't happen. Potential rapist? This isn't Minority Report - you don't go to jail before you commit a crime in this country.

Think about it, you are talking about a person going to bars, getting drunk, and who has done drugs recently. Maybe she's being paranoid? Wonder what she took...

This isn't the same "friend" who drives drunk all the time, is it?
you are right, and I though of the slander/libel thing. But if no one sees you putting it up then you don't know where it came from. Such as putting them up in the girls bathroom when it's not full (does that ever happen at a bar?).

The thing is that I knew legally there is nothing that can be done to this guy.

It's sad that someone can basically get away with slipping someone whatever they want, so long as nobody sees them and they never really succeed in taking them home.

No wonder creeps try this. Doesn't work, nothing to lose. It works, and it's still his word against hers to prove consent.

It's very sad, but fact of life.

Rules for girls at bars.

Don't accept a drink from someone you don't know unless you saw it being made and it came from the bartender/server straight to you.

If you have a drink of your own, when you are not drinking it, keep you hand covering the top of it at all times.

The best drink to get is bottled ones where the top is removed in front of you like beer/wine cooler type drinks.

I always make anyone I'm with follow those. Covering your drink with a coaster when you're up is great too... it takes way more obvious effort to mess with it.

I already called and spoke with the bartender we know, and told him to point the dude out to security if he comes in again.

You know what would be great. Pull the ole switcharoo. Trick him into drinking the tainted drink next time. Then when he's out of it drive him to the middle of nowhere take all of his clothes and leave him in his car. Hide the keys in the glove box.

As long as you go out with friends, there should be someone watching your back. Even if you do get drugged, you're friends should be able to take care of you.

Thankfully, her friend told her she wanted to leave bc the guy was getting creepy and my friend was acting strange. Otherwise who knows what could have happened...

When I was in college a few years back I went to the bar with 2 of my female co-workers. One of the two girls was interested in one of the bartenders at this particular bar. Long story short, they both went to the bartender and ordered drinks. Only the one girl gave me her drink instead. This was in college, I had a ridiculously high tolerance, and was relatively sober (only 2 drinks up to that point in the night), and I am 6'2" and was 170 lbs back then. Within 10 minutes I had blacked out, left the bar, and wandered 5 blocks away. My friends somehow found me, took me to my apartment, and I spent the next 3 hours vomitting profusely. I woke up the next morning and felt like I had the flu. Couldn't keep any food down, sweating, pounding headache, and the right side of my body was black and blue from apparently falling down many times when I wandered the 5 blocks. Needless to say the guy spiked the girls drink, only I drank it instead. I can't imagine what would have happened to her if she had drank it instead of me. Some guys out there are sick bastards.

I know it's late response, but i just felt like it's still good info to read.

I'm not a lawyer, or law enforcement officer of any kind, but through my own experiences i can tell you a few things (which i won't be liable for):

It depends on what kind of drugs she was using during that month. If she's a regular pot smoker, it takes a minimum of one month to get it out of your system. If she doesn't smoke weed regularly, it only takes 3 days. If it's E, meth, or coke i believe it CAN be gone in 3 days.

As far as prosecution goes, it depends on his financial standing and location. If it's kind of a small suburban city, the chances of him being prosecuted are much more likely than a big city.

Also, if he can afford a lawyer, it's almost gauranteed he'll get off the hook - but you'll at least shake him up and make him spend lots of money (hopefully making him think twice about trying to pull that again).
-hard to prove it was him, anyone could have slipped her the date rape drug
-hard to price it was that night
-impossible to prove which drink it was
-etc, etc

if he's using a public defender, he'll probably be encouraged, and will end up doing some sort of plea bargain, where he'll get minimal jail time and probation - fines, etc. Which will hopefully scare him.

As far as your friend being tried for drugs found in her system, it kind of makes her case harder to prove, she loses credibility.

That being said, even if your friend was going to be given a TICKET for smoking weed [(citation) assuming it's weed because of its popularity], she could really be saving the life of that guy's next victim.

i hope this helps you guys make a decision.

Good luck with your situation and sorry it had to happen to your friend.

ps: they sell those drug detection tests at walgreens and other drug stores now too i think, it's like 20 bucks.. you can see if you come up for anything else with that..
