not tipping = illegal?
my friend is a hostess at a resturant. we were at some resturant with some people and she said it was illegal not to tip. I said hell no tips are 100% optional. but im just saying this because she was the only person to ever say they were required. Anyone know a definite answer?
It depends. If the restaurant states that a gratuity will automatically be added to the bill, then the customer is under legal obligation to pay their entire bill upon receipt.
Otherwise, not tipping in general is not illegal but certainly in bad taste. It is legal for restaurants to pay their wait-staff a sub-minimum wage as there is the understanding that they will also make tips.
Personally, I believe if the service is bad...a small tip makes for a stronger message than no tip at all.

I once had a waiter so bad that for a tip I left a condom with a note on it that read "Please use this, stupid people shouldn't breed." When you put in the order TWICE and neither time was it anything close to what we asked for (I ordered steak, my friend ordered ribs, I got chicken, he got spaghetti, next time around we BOTH got chicken) that is the tip you will get.
