You're right about the useful vs. useless argument in that if something is causing harm (health or otherwise), we shouldn't try to justify it, although the fact that we still use combustion engines which pollute is proof that we do. But are smokers cutting back because they are realizing tobacco smoke kills in the same way that auto manufacturers are trying to produce electric vehicles in order to cut back on pollution?
And the annoying thing being in the eye of the beholder is one thing. This not like saying bad fashion sense should be punished, this is about our health. The annoyance comes not from the fact that the smell is foul (like BO or feet), but that the substance entering our bodies is causing actual physical harm.
And people who need nicotine as a drug to curb the effects of their physical disorders is not the same as smoking (are they actually smoking cigarettes or using some kind of nicotine patch or what?). I am sure they can take in nicotine in a way that does not require producing second hand smoke. We are talking about people actually lighting up cigarettes and expelling second hand smoke.
I don't think there are any laws against annoying behavior, are there? Laws against smoking are made not because they are annoying (in the same sense as picking your nose is annoying) but because they cause adverse health effects.
