Actually I think it is the management of the property, not the restaurant. Also, the security guards were off-duty DPS officers.

JRM, would you mind if I asked you exactly what type of law enforcement activities you do? I'm pretty interested in what you do, sounds like a good career to get into.

Also JRM, are you saying that being a security guard while also a DPS officer is illegal? or just looked down upon?

Because it seems like some companies/party promoters use off-duty officers to secure their businesses or watch over parties like at Raves.

Give me a PM and I'll tell you! Any related duties should never be used. To do so would not only bring ridicule on the officer but would do the same for the department he works for. Lines of operation are to similar. An officer cannot except gratuities of any kind for performing his duties except by the agency he works for.

Think about it this way, Lets say that the officer in question had been getting paid by a private concern for services rendered as a security guard. He returns to his normal duties everyday as an employed city officer, paid by the municipality he resided in. One day the employer of the security firm breaks local laws or ordinances. This officer is assigned to the case as an investigator. The investigation is completed and his night time employer is not charged with any offense and it never reaches a hearing or trial. Do you see where I'm going with this? When something gives the impression of wrong doing even though there is no wrong doing, it becomes a conflict. When it evolves law enforcement officer working as security guards it is a conflict of the same interest. Maybe the officer looked the other way, maybe he didn't, but to a good lawyer this is a loop hole that can completely dismiss charges. Especially, if he was the arresting or investigating official.

So this type of employment is regulated against. Rather it be federal, state, or local. Hence, you have a conflict of interest.

oh ok, I have more clear understanding of it now. I definitely knew there was a conflict of interest, that was a given, but I wasn't sure how this type of employment was looked upon.

I hear you JRM, not that Im disputing you. I agree that they cannot accept any monies while on-duty, but what about off-duty?

I see police officers being hired by private people/companies all the time. In addition, they are wearing their (police)uniforms and are off-duty. Clubs, social gatherings, parking lots etc... this list is a mile long.
