ya man~ pedestrians are always right... don't think 100 some pounds of flesh and bones can withstand a huge block of metal in their face.

Anyone know which California state traffic statute number the "pedstrians are always right" statute is? Because if you're ever cited as the at fault vehicle in a traffic accident, there will be a statute number and description of the violation listed. And I bet if any of you point to a staute, you will actually find that it is actually going to be something else.

I'm more familiar with FL law than CA law, but based on FL law:

...2) There would be no manslaughter charge.

I know how you feel BG. I had a five year old careening out of control dart from between two cars right in front of me. He hit my car from the side just as I was almost stopped. When I saw his face disappear from sight, I thought he was a dead kid. The car stopped with the tires about 5 inches from his head.

I jumped out of the car to see if he was alright. The kid was apologizing like crazy, because he knew his Mom would have killed him for riding into the street. It turned out OK, all he had was a bloody nose, because he hit me faster than I hit him.

I was 17 and spent the rest of the day dealing with the fact that I almost killed a kid.

Be proud that you were paying attention! Good Job!

Apparently she stopped in time, so she was attentively driving.
I did say that BG would have been at fault. But how about the mother's "failure of attentive operation" of a child.

I'm almost 100% positive. Are there different kinds of east indian people like there are chinese? I'm not very knowledgeable about that. I don't see how it would have any bearing on the situation though.

On of the reasons I also thought I killed the girl was because her older sister was screaming, "YOU HIT HER YOU HIT HER!!!" Over and over again, when in fact, she tripped on a pot hole and hit MY car.
