questions for lawyers.... RAPE...
My friend is telling me, that 3 weeks ago, she was drinking with this guy at her place... she got really drunk, and passed out. She woke up in the middle of the night, to him having sex with her. She said"no... nothing was suppose to happen" and passed out again.
The next day, she went to the police, and to the hospital. The cops won't do anything, cause they said she was drunk, and doesn't remember anything. And the guy filled in the parts she didn't remember. He said that she never said no.
She is in Rhode Island. if that helps.
My question is, if you are too drunk to say yes or no, isn't it a no? help on this please....

Ya, I think that constitues as rape because she wasn't in the right state of mind to make a decision, and since she wasn't concious of her surroundings, and had no control over the events, I would say that's rape. It was technically against her will, or was it?

Odd, here in California we are told that if she isn't sober, if she's begging for it and you do it (even if you are not sober either) guess what?
