ok.. first of all... she wants nothing from me... She told me this after it happened 3 weeks ago cause i noticed that she was always depressed and sad.... so i probed her.. and asked her what is going on... so she told me..
Second, she is not a Hoe. Just because some guy took advantage of her, while she was passed out, she is a Hoe?
I agree that she made a really stupid mistake by inviting the guy over. but how many of us have female friends that we hang out with? how many would think about having sex with them, if they were passed out? if you raise your hand, you are one sick F*ck.
Anyway, the reason for this post, is to get a lawyers opinion on this matter.....

The thing about calling her a whore is just wrong. You don't know the girl or the situation.
The girl got really drunk is what we heard, but did she knowingly get that wasted, or was the guy responsible for egging her on, did she not know her tolerance. Oftentimes I've seen girls overdrink

Its completely wrong what the guy did obviously, but this situation would have probably never happened if she acted responsibly.

Just my $.02, but this sounds like the classic case of a guy and a girl getting drunk, having sex, her regretting it when she sobers up, and him being guilty until proven innocent.
I don't mean to downplay the tragedy of an "actual" rape, but all too often the chick is all into it, can't get enough, then changes her mind once the buzz wears off, and all of a sudden, the guy is in a world of $hit.
Whatever the case, she is partially responsible for what happened.

She could have always asked him to leave before she passed out if she wasn't interested in him. What did she expect when she asked the guy over to get hammered? She may not be a hoe, but ignorant at the least.

PS - if something was slipped in her drink.. that's another story.
Good grief...just look at the RI statutes. It's not rocket science. It would be a he said/she said situation. Prosecution would need a decent rape kit. From there they have to prove the required elements of 11-37-2 or 11-37-4. Jury is the finder of facts and they make a decision based on what they believe to be the facts. I doubt he would be convicted. And, yes, I'm a lawyer, and no, this isn't any form of advice--just what I found in their statutes and what generally needs to be proven in a criminal case. //begin fine print//laws vary from state to state//end find print//
