Default Video aggregation / legality

I've been fooling with wordpress and developed the following site:

www.flyinglap.net

Basically, a video aggregator, or, curator. whatever you wanna call it. Sites like devour.com generate lots of traffic, essentially, doing the same thing e.g. using other peoples content, sorting and showing us the best stuff.

My question is, is it legal, once the site monetizes. Each video gets proper source recognition. Devour.com, carbuzz.com etc. all have lengthy disclaimers / terms and conditions. Do these "disclaimers" give them carte blanche to use whatever content they want?

All videos are embedded from YouTube. Fair Use laws are tricky, the lines are blurred. Anybody have any experience with this? Any I.P attorney's on the site?

You may be inviting the poop monster into your house because of going through wordpress. I'd have just started a fresh site, without wordpress as the underlying platform: as a blogging medium, they may be getting to dip their beak AND dictate terms. . .

. . . but yeah, can't wait for an actual lawyer to pipe up. While you're at it, if you think this will make real money, go find an IP lawyer. . .
