Default Low/High beam issue

So i'm having an issue with my 2008 AP2. I just noticed recently that when all of my lights are off, if i pull the light level back to use high beam, both my low and high beams come on. When i drive at night and turn on my lights everything works as normal, so at 1 click my parking lights come on, second click my high beam comes on however with the lights totally off if you pull the light lever towards you both low and high beams come on.

Has this happened to anyone, could it be a faulty switch? I think its kind of cool but worry that it'll affect me from passing inspection.

your post is really confusing.
is it like this
first click = parking light
second click = LOW beam (HID not the halogen on the inside)
Pull back = lowbeam and highbeam

if thats the case then it is normal

no so the problemm is:

Lights off, nothing turned on, pull the head light switch towards you both low and high beam come on. Shouldn't it only be high beam?

I know if the lights are on and you pull back the lever both should come on but how about if the lights are OFF and you pull back the lever?

The "pull the lever back" is not how you turn on the high beams. It's the "flash to pass" switch, which turns on both the high beams and the low beams. It does this, on all years S2000, whether the headlights are on or off.
