1 you will more than likely need a police report
2 she likely denies everything - if she can remember
3 she already knew she was a Mom before she got in her car and was driving drunk
4 the other person was likely drunk - what sober person gets in a car and lets a drunk drive?
5 this is actually a very INexpensive lesson - you were talking to the drug (alcohol) not the person - learn from it before it costs you MUCH more than just money
6 you were not being a jerk, if you had called the cops - see #3 - you have RIGHTS to be safe, she has a driving PRIVILEDGE there is a difference. Check the newspapers and hope that the #2 driver didn't wipe out some family of 4 on the way home - feel better now?

If you take anything away from this experience I hope it #5. Things don't "just happen" we make choices that lead to consequences. The drug and their best friend (addict) prey on the inexperienced (guess why I have these feelings) - you are now experienced, welcome to the club.

new update guys, with good news and bad news of course. good news is the insurance company of the girl that hit me is admitting that their insured was at fault and accept full liabilty for the accident. bad news is that the person who hit me is denying that she caused that much damage (like she would even know how much it cost) to my car. i brought it to the adjuster (mercury... girl's insurance) to take a look at the damages and he gave me a estimate of $987 for the repairs. however now i have to bring my car to another person, another mercury inspector to approve the cost of the repairs because this lady is saying im adding extra damages. i was just left in a trance when i heard this, as if she would really know how much it would cost to fix the damages. also correct me if im wrong, but as i was told the lady had a $500 deductible, and it wouldnt matter to her if the damages are $1 or if they were $12,000... she would end up paying the same amount, which is her $500 deductible.

on another note... my OEM honda lip has a scratch on it, which is kind of deep. but my insurance nor mercury would cover any of that damage on that because they consider it an aftermarket part... yes even if it is OEM. both of the companies told me that its a bolt-on. wth?

also i wish i would have called the cops now... i messed up on that move..

Wow bro i would raise the on that one! Maybee you can get a letter from the dealer that you purchased the car from stating that it is otherwise? Its like if someone stole your antenna would they consider that bolt on too? Such drama! good luck.

its only covered by your insurance if you listed that option when your purchased your policy. mercury insurance (the liable carrier) should pay regardless. and the $500 deductible only applies to your own vehicle, not when you cause damages to another

i dont think i made myself clear on my last statement...

yes you are completely right about the $500 deductible. shes the one that pays it... but what i was stating is that no matter what she has to pay that. regardless if she cause $1 worth of damage or $15,000 because were going through insurance. im pissed off because if she already has to pay $500 out of her pocket... for almost $1000 worth of damage to my car... why would she say its too much? her and i already going through insurance, its not like she saves any money saying she doesnt think the damage should cost that much. also, now she is prolonging my process of trying to have my car repaired.

as for the lip... i agree with what your saying... but its OEM. take this for instance, as a senario, what if you purchased a car from the dealer with a hardtop. drove it out of the lot with the hardtop. then bam! a trucker smashed in your car... wouldnt you be pissed if the insurance said that they wouldnt pay for that because its a bolt on. this was news to me as of today when i asked the adjuster to add my lip repair on bill.

they (the at fault insurance company) should be responsible for fixing or replacing your parts that were damaged in the accident to your satisfaction no matter if they were after market or not.

an OEM lip is something that is offered by the manufacturer of your car as an add on through the dealer ship. it should be covered.

its like eddie bauer, AMG, boss, and any other dealer offered upgrade if it was on your car and damaged it should be repaired or replaced to "like before" the accident standards
