Honestly I don't yet. They still have yet to contact the policy holder. So I broke down and called my insurance. They will be looking at the car Thursday and, will give me an answer same day. But I will be contacting my lawyer tomorrow because, I'm sick of all this **** drama!

Sorry to hear about this man, at least you are ok though! Things could have been much worse...

I worked in insurance for a brief period of time, here are just some quick recommendations:

1) Although he wasn't on the insurance policy at the time of the accident, their insurance will likely cover the claim. If you go through your insurance policy, you will need to pay your deductible which you might never get back -one way to prevent that from happening is just going through his insurance policy right away.

2) Your insurance company provides a lawyer to represent you *if necessary* under your policy, if you go out and get your own then your insurance will likely take a "hands-off" policy and assume that your lawyer is going to represent you. Your lawyer expenses will be out-of-pocket and won't be refunded.

I understand all of that. But my lawyer is a friend of the family. And only calling him to see what my options are.

This wreck happened 10/18/13. I called his insurance company after receiving the police report on that following Tuesday. They accepted fault after I faxed them the police report. Had the car taken to a body shop and had the damages looked at. I have a copy of the estimate. And now they refuse to do anything wouldn't return my calls or emails.

This entire time I've been without a rental car. I can't work because my doctor will not clear me.

Forgive me if I sound irritated. I've honestly never dealt with an insurance company like this. Their policy is ridiculously crazy and makes absolutely no sense.

Wow, that is nuts. Glad your okay, I don't know how your insurance work where you live but here were require to have full coverage in case the other driver is not cover so my insurance will cover the damages and will pursue the other driver who is at fault with lawsuits to get their money back.

That's not exactly true. However, there is a point where it's more of a hassle to fix a damaged car than to just replace it. I know someone who used to run a collision shop and also made a side business of buying totaled cars, fixing them and selling them. Your car would be one that he would typically target for his "buy, fix and sell" business. He looked for cars which were damaged only in one area (i.e. a car damaged front and rear would be too much effort, but a front only or rear only collision was less effort/costs). Once he got done, you couldn't tell the cars were ever wrecked (from a visual/driving standpoint).

Sorry to hear about your car. As they always say; metal can be replaced.

Finally getting somewhere after this. The car is a total loss. The bad part is, they think They're going to give me $10,500 for the car.

Never accept the first offer. Hit autotrader and carmax to find comparable cars (same year/mileage) and send them all to your insurance contact.

Not necessarily true, I just finished with my total loss from my accident and the insurance companies usually go off of nada and black book values to see what the car is worth. Autotrader and carmax usually go off of what blue book value states. My S was valued at $15,000 on blue book but the value for nada was $5k less. So the offer they are trying to give you sounds about right. Also, I hope you have aftermarket parts coverage on your policy because they might/might not cover the parts.

I'm sorry for your loss. I def know what you're going through because it just happened to me in September and all I can tell you is it's not fun.

The entire incident sucks! I hope it all works out well for you in the end. Insurance companies are not on the top of my "I like you" list.
