They don't have to be, registering for a Ladies class is voluntary. That said, the biggest reason they still exist these days (in my opinion) is because it allows 4 drivers (2 in Open, 2 in Ladies) to run a single car. Eliminating them would mean getting rid of a lot of participation from women that don't own their own autocross car.
