Doubt he'd actually get jail time but he'll get a fine I think $25 or three times the amount of the check whichever is greater. Jackpot!

Why would you need a lawyer. This is small claims court we're talking about here. No lawyers involved.

First thing is you notify the police in whatever town they are based out of, as well your local police. You can probably get them for fraud of some sort. Also contact your local BBB and the BBB in CA.

After they rattle the cages, if their willing anyway, you file a claim in small claims court.

Bring the the original bill of sale, bring your credit card statements, and bring the bounced check. Since you're in Hawaii (however its spelled) they'll probably rule in absentee against them, and if they don't pay up a warrant will be sent to CA.

And did I mention I hate you for living in Hawaii... you bitch! I was in Maui and kawaii about 12 years ago... so nice.

That law only applies if there were insufficient funds. In this case its more likely that this was the original check finally showing up that was cancelled. In that case this particular law wouldn't apply.

My guess would be he'll get another check in a few days/weeks. This check being the second check they sent out.

For the amount of money being dealt with here, you'd think they'd have used fedex to make sure their check got to where it was going instead US postal. Not too smart on their part.

well easiest way to figure out if the check was the original or the second. Check the date on the check and the postmark date on the envelope.

When I got the check back, the reason for them sending it back was because of insufficient funds. It was stated on the sheet that came with the check. I got charged a fee also because his check bounced.

Follow the guidelines for sending a Written Demand. Hopefully that would be enough to get your money back. If not, you stand to win an additional $1500. Hopefully that is enough to compensate you for the
