Make sure you have a lawyer write up a contract of sorts for the settlement that includes any unforeseen injuries that may show up in the next 6 months - year. Depending on what your wife's injuries were there is always a chance of back/neck/spinal problems that don't always show up right away.

It sounds like this will work out for you with the trucking company. Beware of the body shop doing the repair. Make sure they dont hide damage.

If you were to literally drive the car off the lot and get in a wreck then this might be an option but the insurance company will not put you in a better place then you were. If he has 5000 miles on his car now they will not buy a new one for him with less miles. They see a fixed car from the body shop as good as new, which we all know is not the fact. I had to fight my insurance company because they wanted to straighten the frame of my wifes car after an accident. To me if the frame has been twisted the car should not be driven. That is unsafe

Like said above though, make sure if you settle out of court that you have a lawyer write up a contract that states that they will cover any unforseen injuries. This happens all too often

Yes I see the point. If the OP has a lawyer, he might ask that this matter be brought up to the trucking company who seem to be pretty accomodating so far. A used (virgin) '06 with like milage should be fair compensation . If he's lucky, they might just offer a new car especially if they can't find a reasonable replacement right away.
It would't hurt to ask. A "no" answer to this request seems to me to be a little confrontational and petty considering his wife was hurt which could be many ,many dollars more than just the car.
