Honda Negligence? Help!
OK, the dealer screwed up. That screw up, however, was not necessarily the cause of this accident or the damage to your car. Could it have contributed? Maybe, but that is difficult to prove in this specific case.
If the insurance company is going to pay for the repairs, and they feel that the dealer's failure to remove the spacers contributed to their expense of repairing the car, then they will file a subrogation claim against the dealer, NOT Honda. The insurance company will ask for all of their money back, plus your deductible to return to you. That is the process, and that is why you purchased insurance, to have them do the fighting for you. It may not be a successful claim. In which case, you have a repaired car and are out your deductible.
Based on the postings, you were not injured. The "potential" for injury was there, but it didn't happen. Suing the dealer for a "potential" injury just doesn't work, especially since the actual causation of the accident and the damage can have multiple contributing factors. What part of it all are they responsible for? Are they responsible for the other driver cutting you off? Not judging here, but were you traveling at the speed limit? Was the road wet? Etc etc etc. If the spacers were the total cause, I think that you would have spun out on your first turn out of the dealer.
Basically, let the insurance company handle it. If the dealer is stand up, they will probably try to do something nice for you, but they're not obligated to do so.
Sorry for the diatribe, but I just get soooo sick of everybody wanting to sue everybody over everything. Most people just wonder why cars and insurance are expensive without really thinking about it. How much less would the S2K have cost you if Honda didn't have to worry about frivolous lawsuits?

Thank you all for the interest and the love...this is why I love(d) having an S2K....such a tight community. I had a G35 prior, not even close.
For an update, I'm meeting with the JAG in an hour. After that I will write a long update and let everyone know what is going on. I'm happy people are at least checking their cars...oh and I'm not trying to get rich or retire off of this. I just want what I paid for and that included getting charged $600 for a prep and a car that was supposed to have a sound suspension.
