Honda Negligence? Help!
At the very least I'd go to the dealership and demand a loaner vehicle. They may not, as a general practice, give normal customers loaner vehicles, but I think they could make an exception in this case... especially if they thought it would keep you happy/quiet. Obviously, still pursue the case though.
Pics are good but it is your eyewitness account vs. a documented PDI sheet signed and dated saying they did it. The tech won't back you up and your adjuster won't go to court over it (although they'll say they'd like to, they will subrogate the dealership maybe, past that it really depends but usually someone swerving and losing control can't be blamed on pieces of foam stuck in the springs). I say talk to the dealership management, see if they'll give you your deductible back as a sign of goodwill and say free service for a few years (if you still trust them), etc. They won't give you a new car or all new suspension or anything else unless you sue however. But since no one suffered any major injuries it's not worth suing. You only get big cash settlements when pain and suffering (not that made up mental anguish crap) is involved on fractures, etc.
I have the PDI checklist and they did check it off and sign they removed the spacers. Obviously they didn't. I went and spoke with the dealership and they informed me they it wasn't a question if they were removed - in their words, "obviously they weren't." Hence, they are going to talk to their lawyers and figure out where they want to go from here.
As for little pieces of foam. These are not little pieces of foam. Rather, they are large and stiff pieces of rubber. If they were "foam", the Honda factory wouldn't write on them, "do not driver over 10 or 20 miles an hour with these installed as they can damage the suspension and create unsafe driving conditions."
In short, I'm not getting back into a car that I think has a faulty suspension damaged by 6,000 MILES with these installed in them.
I never received from the dealership the car that I paid for. They charged me $600 for a "prep" fee, what did they prep? They signed off on removing the spring stiffners and didn't. Now there is an accident. I paid for a car, without a possibly damaged suspension, and one that wouldn't contribute to an accident. Unfortunately, that is what I received, and now I am asking for my original purchase to be delivered. I don't see anything wrong with that.

The dealer is clearly at fault for not removing the spacers. Those spacers are installed so they can tie the car down for the transport across the ocean. They limit the suspension travel to almost no movement. So you were driving around with little to no suspension movement for 6K. That must have felt wierd. It will be nice when you get a new one to feel how they are supposed to handle.
I love how people get paranoid over these things (like I did). It's like "Oh my gosh, what if my flux capacitor isn't installed correctly?"

You must have gotten in a lot of arguments with 00-03 owners who gave you sh%t for the 04-5 soft ride. "what soft ride, I've got kidney failure".

don't bring a lawyer in just yet...have the INS co deal with it and you yourself should go to the dealership yourself and talk with the general manager. Ask for exactly what you want
