Update to my original post. I will post pics soon, I promise.

After showing the tear and how the latch rests on it to the SM (of dealership),
AHM has decided to pay for all materials for new top, I still need to pay for
the labor ($656 incl taxes). I am trying to negotiate on that also.

Hey man, this issue is complete BS. its TOTALLY a design defect. when i described it to people on the Southern California board, NO one believed me that it was physically possible. anyways, you hit right on the nail...its bound to happen if you forget to lock your latch when you put the top down. here is my thread (pics included), and it has happend to a few others.

my solution: claimed vandalism on my insurance and payed a $300 deductible. wouldve cost $2500 out of pocket otherwise.

One day I lowered the top on my 2005 (with only 3000 miles) and the top became trapped under the drivers side latch. As it passed over my head behind me I heard a pop and rip sound. I raised the top again and sunlight streamed in through an 1 inch x 2 inch "L" shaped rip. I prepared myself for an argument from Honda or an offer to repair the tear. I went to the dealer service manager, he called his Honda representative and 10 minutes after I showed him the damage, they agreed to replace the top under warranty. No hassles!

Awesome that you were able to get comped for this. but for you owners out there who are not under warranty, BEWARE and BE CAREFUL. ALWAYS lock your latches.

I noticed this design flaw also. I'm thinking about putting something there to cushion it. I also started to use the tonneu cover more also on long drives, so that the top won't flap in the wind and rub the latch.

I thought this design flaw was fixed in later models. I have a 2004, should I worry?

Just get a new convert top by robbins, canvas or vinyl is still way better than OEM

I have a tear right behind the drivers door where there is a seam. I thinks it's just age though.
I have those on both sides of my top.

Neither leaks, so I am not concerned about it.

Oh nice, insurance fraud. What a nice way to solve your problems. Let all the other S2000 owners pay for you
