bdiehl , I am sorry to hear about your s2k but glad to hear that nobody was injured. As far as "No fault" insurance, this only pertains to injuries, which means that if you are injured in a accident you have to file a claim for injuries only with your own insurance company. Florida is a motified compartive state in regards to liability. Which means that a percentage of liability can be assigned to each party if applicable, but from your accident one would appear that the other driver was liable for the accident at 100%.

As far as your s2k being a total, FL has a statue of the 80% threshold, which basically means that if the total cost of repairs exceed the "actual cash value" or market value by more than 80% the vehicle has to be deemed a total loss by law and cannot be repaired and given a clean title. Most insurance companies work between 70% though because of the expected repair costs on a heavy impact.

From what you described though and the residual value of your vehicle, it sounds repairable, but I would have to see photos before a better guestimation could be made.

Your best bet is to file a claim with the at fault parties insurance company, and they should be able to assist you. One thing though is to be patient in the begining of the claims process as the other driver's insurance will have to confirm their liability position before they can move forward with the repairs to your vehicle, and provide you with a rental. This does take some time which depends on their ability to contact the driver, witnesses and secure a copy of the police report. Each company is different and requires more or less to confirm their liability position, but it always takes a few days.

Thanks all for the good wishes. Swirvn, thanks for the insurance lesson. That's what my State Farm agent told me too, so you were well informed.

Apparrently the guy that hit me thinks it's my fault and already had filed with my ins company by 9:00 am this morning....my police report said that he was at fault, and his says I was. Hmmmm...but I have the final one filed I guess.

So I spoke with the adjuster and she said that it will be moved to a State Farm facility and be looked at within the next couple of days. I did take some pics of the damage, I just have to get them off of my camera.

Luckily, I have a spare car so I don't need to do the rental thing. If they do end up being able to fix the car, it will be marked as being in an accident and will be worth less when I go to sell it....but I guess I can't do much about that, huh.

I'll keep you posted as to what happens. Oh, and it's a beautiful day on the Pinellas suncoast of Florida. Sunny, warm....a great day for a convertible.........

Sounds similar to what happened to me. Some guy hit me on my front right and damaged my headlight/wheel/side fender but once it was going up the flatbed my wheel looked really bad...like really bad. Its just that the front right wheel was bent in by the accident and sliding up the flatbed made it even worse but 3 weeks or so later i got my baby back and i was Happy! Now its going to suck because your going to miss your car so much. Driving around in a Pt Crusier wasnt fun at all for me but Hoepfully everything works out for you.

What swirvn said. Your ins company will be glad to help you get the money from his ins company because they don't want to pay. I wouldn't worry too much. Hopefully there is no frame damage. Good Luck

I thought the whole point of "no fault" insurance is that you only have to deal with your own insurance company. So where does this "file a claim with the at fault party" fit in with "no fault"? Or is this an issue only during this limbo period when the no fault expired and when it is resumes again in 2008?

Next question: Why would there be two different (and conflicting) police reports?

In my state (and apparently Florida), either and/or both parties can file an accident report with the police. In fact, over a certain dollar value they are required to do so. The exception is if an actual police officer is there and they file the report.
