Being in stock at our suppliers, and being in stock at OUR warehouse are 2 differnet things.
Both items were sourced from our distributors.

Talked to my father who happends to be a lawyer (not throwning names around) but you win bike , here's why. Evasive has there return policy , in order for you to accept there policy or terms of use , or there privacy policy you must click something saying I agree with these policies that the website holds. Unfortunently with evasives site there is no such thing. Therefore you are not required to pay re-stocking fees. If you look on websites such as amazon or any other retailer there will be a part during the checkout that says you've read the terms and conditions. Evasive has no such contract and you are not legally bound to pay a restocking fee for any condition listed. You are by law in the state of california given a 14 day window to return a product that is demed by the buyer as unsatisfactory. Good luck Evasive , but Bike I suggest if they don't want to pay , just send them a subpeona
When items are special ordered it is almost always a losing situation for the shop if and when the buyer backs out.
If it was a normally stocked item then 30% would be high, but for a special order item it is not.
When any consumer buys a special order item they should make sure ahead of time that they really want the part, or pay the re-stocking fee, or sell the item and try to get the money back that way.
I am sorry for both parties involved, but I do not see how the situation would have been different had the OP went to another shop. Bulletproof, JHP, Inline Four etc. etc. would have all done the same thing given the situation. I dont know if their fee is 30%, but I bet its close to that amount, at least 20%.
If the lugs are $100.00 what material did the OP think they were? Ti Lugs retail at over $500.00 and all the other lugs I've seen available are alluminum. Not trying to flame just thinking more research should have been done before placing the order.
I think the OP had buyer's remorse more than not being happy with the product. He placed an order and got exactly what he ordered. Its not like the parts came and they were for a different application or were all banged up or broken.
Sorry for the long post.

OP seems out of line to me. He want's to return a CF spark plug cover, cuz it wasn't what he expected? Do some research dude. He never mentioned this part because he would be called out as a douche
As well, Evasives website is not a webpedia. You should do your research, prior to purchasing. You are the typical car sales man's wet dream. Are you gonna buy a car, because it looks fast? without doing research? you think the dealership will take it back with that kind of excuse? they would laugh at you and then escort you off the lot.
Not trying to be a now it all, but I really think that companies like evasive should ALL start practicing the no refunds of exchanges policy. Unless it is defective at the time of shipment.
If I owned Evasive, I would too practice the 30% restocking fee ALL THE TIME WITH NO EXCEPTIONS! It will cut back on people like the OP not doing their research then trying to stick them with items that they cant sell regularly.
Evasive has probably already invested over double their profit off this case. You think they should make S2KI pay for it?
I bet the OP is the kind of guy that would ask the boards....what kind of exhaust sounds good?

. Not to mention going to court over $100.00 bucks is a waste of time when the OP could probably sell them for full retail on the web
.
If I am not mistaking, I dont think a retailer has to (by law) have a return policy. It has been so regularly practiced, now these days. that retailers are forced into making a return policy to compete with other companies.
I saw it on Peoples court once
Judge Mulian is so HOT

lol judge mulian... federal law doesn't govern a return policy , CA on the other hand does. As far as buyers remorse , yea I do believe that if you don't like the product you should be able to give it back. I do believe in a restocking fee. I was just checking the flaws of there site vs state law. Took 20 minutes to notice the flaws and the one is the biggest one being not required to accept the policy.
In all honesty, you should have done your research about the products,
I think if you can afford those parts you should be mature enough to know when buying car parts is like throwing away money anyways.
I say split it in half, evasive charges him 15% restocking fee and call it a day.
