my S2000 is horribly hurt!
lets hope so.
In the packet they sent me, it said in red ink that lying or misleading an isurer with intent to defraud or injure is a third degree felony. Hopefully my insurance company or hers persues this against the lady that lied about the accident.

Question, were you turning right or was she so far out of her lane that it hit your right side and spun you a bit? Just curious, because judging from the damage, the right tail took the initial hit, turned the car and she ended up putting a nice long dent in the side and right door probably after the initial hit.
Not to add any more to the pot, but GET A LAWYER. The other party's insurance carrier is sending you packets that a lawyer normally "filters" down to you. I would not sign, fill-out, speak, or otherwise communicate in any fashion with the other party or their legal representative.
Get legal advice, either on your own or from your insurance company.

i was in the right straight lane. she was wandering lanes, and according to her memory she was turning right. she wasn't fully in the right turn lane and thus hit me on the passenger rear. the damage was only to the rear, but the force of the impact damaged the frame which damaged the door.

OK, they have accepted liability.
they are offering 21800 with tax. according to them, the honda body kit and exhuaust are not covered because they are personal preference. bullshit (USAA even said so). They won't cover the warranty or any other dealer fees, either.
The messed up thing is that the property and the injury are handled by 2 different people who DO NOT COLLABORATE. I implied to the property lady that it would be in Hartford's best interest to just give me what I want being this is a DUI+injury. She did not agree as she thinks it is in Hartford's interest to give me the fair value for the car only. This way of thinking WILL COST THEM!
I spoke with an attorney and he said that this has all of the requirements for a successful case. He said that it would be handled on a contingency basis if I decide to go forward. He was very low-pressure and recommended I wait a few days to see if I still have pain in my neck and back. I hate having to sue for injury just to cover the cost of the car, but MONEY IS MONEY to me.
USAA has also offered to pay the claim and subrogate it. She said all of the things I listed do have value, but she said it may or may not be more than Hartord's. They're evaluating it; if it isn't enough I'll probably persue the "nuclear option" by getting a lawyer involved.

Lawyer will save you some hassel but not time. I'd just call her insurance company back and say unthing less that what I've asked for is unacceptable. Then "So when are you sending me my check infull" If that doesn't pay off a lawyer and a trip to the ER.

I am PISSED with this lady. Her insurance had better kiss my ass. My car blue books at $20.8, without the honda body kit and my Nvidia exhaust (I will insist on $22K). That should be enough for a 2002. If the car is not totalled, do you think it can be repaired? It's going to need a new rear floor section, so it's a lot of work.
You are not looking at the big picture here.
Go get yourself a body injury lawyer and sue the heck out of her insurance and her. It is not only the car, but also your body injuries.....etc.
No mercy, man, take her out of the street. It is like you performing a public service. You could have saved other people's lives.
I hate drunk drivers.
I realize that. It's a good thing that the two claims are separate. The body shop guy recommended NOT releasing the car to them. That way, they will continue to incur a $30 a day storage fee until they cave. He says it is very effective
I have the sit-down consultation with a lawyer friday. I'm not hesitant about a lawsuit anymore. This lady may skip a DUI charge. DUI is right up there with rape and murder IMO...it kills MORE than both combined. If I can't get her in jail, I'll get her ass off the road and on the BUS!
Just for fun, I'll do a small claims for my exhaust if I don't get anywhere on the property claim. Then I'll call every 5 minutes asking if she has the money.

At least you will have enough money to get a new S2000
