I have CHUBB Insurance. Not only are they consistantly one of the highest rated insurance carriers every year in all categories, but they have agreed value policies. Meaning you insure your car for what you paid for it including taxes, if you want to include them. Even after 5+ years if you paid $33k for your car but the book value is only $21k you get the $33k. CHUBB's policy is that in the event that your car is totaled they want you to have a brand new car like you paid for instead of receiving a lessor amount and possibly not affording a new car. I pay about $200 more a year than I did with Allstate but I have a lessor deductible and the agreed value policy.

that's a separate claim. injury/medical/pain/emotional distress claims are on the bodily injury side.
I'm sure when USAA subrogates it they'll add in their admin costs, too! From what I hear, USAA gets what they want because they've earned a "tough but fair" rep in the industry.

On a happy note, I've aquired a 2003 silverstone with 16,100 miles on it. Perfect paint, VIN stickers match on all panels, and drives great. The dealer I bought it from, Island Lincoln/Mercury in Merrit Island, FL, was awesome. I made an offer that I thought was fair to them; the negotiating "gap" was only $600 so it was pretty painless.
A little off topic, the suspension does feel noticeably different from my old one, and the steering programming is different, too. The nicer interior and glass window make it feel classier, too. The leather is different, a little duller but it feels thicker. I still have my Rick's shift boot and console cover; the vinyl console is better than carpet, but not as nice as the Rick's leather one.

I consulted with a lawyer today. He thinks I have a case and will take it on a contingency basis. In FL, you have to have a "permanent" injury to collect anything beyond medical bills. I put it in quotes because that is, of course, subjective. If my back is still hurting next week I'll be going to a back specialist...one my attorney approves, of course.
Anyway, I'm enjoying my 2003. It was $25K which I'm happy with given the year and mileage. Condition was also perfect. After tax, it looks like it'll only be about $1500 over the check I should get. I say should because I don't have it yet (I don't count it done until done), but I know the amount and all. My warranty provider will also give me a prorated refund (about $500) once the lien is released.
I think I'm going to get that Honda spoiler that came out in 2004 first. I also want to find out which salvage yard gets my S so that I can buy the lip from them. I would buy the side strakes but one of them is missing due to the accident.

USAA doesn't get what they want...I work subrogation...we go to arbitration with them all the time. USAA is a good company however and it's cool they are giving you more for your car than the other company. Good luck with the outcome of your car and injuries. I'm glad they totalled it, much easier than dealing with repairs. Good luck with the new car too, hopefully your injury settlement will be enough to provide nice parts for it
i would imagine usaa would get this one. the difference is really the dealer options and my exhaust hartford tried to tell me was worth nothing as it was a preference. they also told me that they adjust $1400 to adjust for the fact that my car was not on a dealer lot; they don't believe that you should let a dealer make profit (THEIR WORDS). I am not bound to hartford's policies, I'm bound to the uniform standards of property damage coverage as I'm a claimant. Regardless, it was really great of USAA to step in.
