Default My situation with insurance

Well here is my situation.

My Fiance was driving my S on a 2 lane Highway and a lady in a Jeep type SUV was traveling in the opposite direction. Well the lady got the bright idea to try to pass a Diesel with a trailer and she did not have enough time to get back in her lane but tried to punch it and ended up clipping the front of the diesel which made her start to spin and flip in to my fiance's lane which forced my fiance to bail at 65 MPH in to the dirt then up a 4 foot incline of dirt. My front driver side wheel's bead came off and curbed my Volk LE37 and scratched my other 3 abit, my less then 2 week old freshly painted J's Racing Carbon 2.0 front bumper was destroyed complety, my side of my car was scratched to all hell, my rear bumper is coming off abit, my newly installed 02+ glass rear window soft top has a tear but not to big. So right now I have no car to drive and alot of dirt, rocks are in the engine bay and I am afraid to move the car and want insurance to take alook and I have not moved my car since the tow truck moved it to where it sits now. I have liability only and my fiance is not insured under my car.

What should I do and what will the outcome be? The trucking company wants to send out their insurance investigator to take a look at my car.

I am afraid there is more damage then I might see

Since you have liability only, it doesn't matter that your girlfriend isn't covered under your insurance, since they won't cover any of this anyway.

It was not her fault and I know they wont cover it. I was trying to find out what would happen with the lady who caused the crash. If I am not mistaken she should have to pay up for all the damages on my car correct?

well, in a perfect world yes. but now, you will have to prove to her insurance company that she was at fault.

i know it sounds easy. I have heard stories to the contrary however. Best of luck.

Maybe get in contact with an insurance lawyer to get some real answers?

Inform your insurance of what happened and give them the sequence as to how it happen. Technically, the lady who trying to pass should be liable for this because if Fiance did not move out of the way, chances are something worse could have happen to her. Let your insurance fight with her insurance would be my solution.

Is she over 25? If so, I would think it would cover regardless if she is in the policy or not. At least my State Farm does.

did your girlfriend get the contact information of the dumb lady? please tell me she did... if so you have a chance.

if she didn't, how can you fight a lady when you cant find her?

What Im guessing is that the SUV the lady was in was probably disabled (so she couldnt have sped off), the police probably came, and probably had a word with your girlfriend, the dumb lady, should have had a chat with the trucker (i would think the trucker pulled over), and your gf would have had a police report available for the insurance company clearly proving she was not at fault, but rather, the lady in the SUV was at fault.

unless your gf left the scene without a police report, or even calling the police, or left before the police even came, i dont see how the other insurance company would even think about denying your claim.

but again... please tell me your gf did all that...

Ladys car was upside down after all was said and done. The lady was fine but her daughter could not move her neck so she was sent in an ambulance. The trucker stopped and 2 police where at the scene. I am waiting to get a face page or police report soon. This happened yesterday. The trucking company is wanting to take a look at the car and I was wondering if my fiance would be considered 3rd party which mean I could take both partys to court? Other wise I don't know why the trucking company would want to see the car.

I was just worried on what to do on my part. Due to me losing my job because I had to leave work to go to the accident I cannot afford to cover ANYTHING right now. Can I get a reputable body shop to tow it to their shop and start getting quotes on what is wrong and how much to fix or should I wait for the go ahead? I need transportation!!!

You have the right to tow your vehicle wherever you like(TX you can, not sure about Cali though).

Your are consider the 3rd party since that lady caused this accident. I don't think you need to worry other than your fiance to make sure she is ok with her back and such. Be sure to let your insurance company know if she is actually hurting!!

Trucker and your insurance will fight with the lady's insurance to get her to pay up.

Well if I am 3rd party that would mean I could go after both partys for damages right? I know it was not the truckers fault but it was their accident and I am sure there could have been things the trucker could have done to help avoid this like braking when he noticed she would not make it in time. Not blaming him I would just see it easier to get back my loses if I have 2 people I can point fingers at.
