HA!
found one with 102k or so (maybe 106k? I posted it in one of these threads) for $4125, with install and a new clutch, $6000
I'm considering the rebuild. We'll see what the new shop says after they look over the "blown" engine.
problem is, I don't have the time to wait a few weeks or more and have the head machined and bottom end rebuilt. Plus, there's no telling what shape the cams are in. As the s2000 is my daily driver, I can wait one week or so (whatever the time to install an engine) since I've got a loaner car from the parent's stable, but a significant rebuild is out of the question.
I don't honestly know what shape the "blown" engine is in since I've lost all faith and trust in the current dealership that has the car. It'll be towed out tomorrow, and I'll forever forget the Gunn dealerships of San Antonio.

If your head is still good, and your bottom end is rebuildable <--- which I would only trust a quality machine shop to make that guarantee, you can have it rebuilt and installed for 2500-3k +-. Machine work, oversized bearings, gasket kit and a few other here and theres you could be up and running in a couple weeks. May be more worth your while to get a used engine for around 3k with 70-80k miles though...not 5500 specially with 160k miles

Didn't you say you had an extended warranty? Why not go through that?
Furthermore, if there was no notation of low oil on your paperwork from Benson, and Honda diagnosed the engine failure as oil related, I would pursue talking to Benson. There's a certain amount (although I'm not sure to what extent) of negligence displayed on their part; and if you get copies of your receipts/paperwork you can prove this. Also I would contact Honda of America; the fact that they're accusing you of illegal activity with zero proof is asinine.
