Someone Scraped My Bumper
Two hours ago, I was approaching a narrow private rd and half way through anther car came from the opposite direction. I decided to yield to him by pulling over to the side....however the driver decides to turn sharply right behind me and scrapes my bumper. I get out and get his insurance info....we call the cops for a police report. This is all standard but what worried me was what the cop said.
He told me that since this was private property the party at fault's insurance would probably no cover me and I would just have to go through my own insurance for the repairs...I was like WTF! I'm confused as to how his insurance wouldn't cover me when HE hit me while I was essentially parked? How is this different from any parking lot accident at Wal Mart....insurance settlements are made in those situations right??
Help!

call your insurance and tell them what happend and give them his information. Also call his insurance and tell them what happend. Let the insurance companies duke it out. Your insurance company will fight in your favor since they obviously dont want to pay for it.
^^That seems like my only option now...I just hate the fact there is a possibility that this will have to come out of my pocket. My deductibles are high enough that its not worth it at all to have my own insurance cover it.
i personally would not talk to their insurance company, as they will do anything to bait you, and will have u answer leading questions (illegal in a court of law, legal for insurance companies trying to save a dollar). I would talk to my/ure insurance company, give them a looooot of details, and become homey with ure agent. Call him/her frequently to make sure they are defending you correctly. A lot of times the agent will be lazy and just "settle" (I used to have aaa, they did that to me 1x and i left them) You pay the insurance company, make them do the work.

i hope this is just a hypothetical question as it was 2 years ago, however even in a walmart parking lot, the situation would be the same. private lot = insurance gonna be a pain.
Contact your insurance company and let them subro. Private lot or not, an accident is an accident.... Your carrier will most likely have a claims adjuster look at the damage, file it, and contact the other person's company. Let your company do the work.. (that's what you pay for after all)
