Testpipe
I'm not sure if its a federal law that you need to have a cat on your car, but I know for a fact that in NY it is illegal to have no cat on your car. The way that they would know is when you go for an inspection and they see that you have no cat on your car because without a cat you cannot pass an emissions test, unless you know someone that can pass your car for a few dollars
I know test pipe is illegal in most states, especially in Cali.. don't know if its a federal law or not. during an emission test they will either lift your car, or stick a mirror under it to check for a cat. I know in CT they will make a point to check on any car that they suspect might be succeptable to this mod.. i.e. they would check an s2000 but maybe not a 95 for taurus. My VW GTI always got checked for a cat.
I don't know how well the stock S cat flows, but you should be able to get a very high flow cat that will help your gains, still keep you legal, and be friendly to mother nature.

I don't want to sound like a 'tree-hugger' here but all you test pipe people do realize that you are increasing the amount of harmful emissions by something like 40 to 50 times greater than they are with a cat (CO2 notwithstanding)? That your car's output now equals the pollutant levels of about 100 honda insights? One of the reasons I originally purchased my first S2000 was that it was the ONLY LEV sports car available at the time.

From a legal standpoint, it would be ill-advised to install a test pipe for use on public streets and highways in any state that has any sort of mandatory vehicle inspection program, whether for safety, emissions, or both. Some states do not have emissions testing requirements. Until a few years ago, the Feds required the states to all have mandatory annual safety inspections, but the Feds dropped the requirement and a number of states dropped mandatory safety inspections.
