Default Top was slashed...again!

I have mercury insurance and they are refusing to cut me a check. The rep says that they will only write a second party check, meaning it will be under my name as well as the repair shop's name. The first time when I got my top slashed, I had All State and they simply just wrote a check after getting quotes from several repair shops. I took the check, paid the body shop, and kept the remaining to make up for the $500 deductable that I had. Now that I have mercury, they are giving a rough time about it. They are already agreeing that they'll pay for it but I want them to cut a check so that I can take it to which ever body shop i please. How can I do this? Is this even possible with Mercury Insurance?

Sorry about your top....but most likely the adjuster is going by Mercury's policy.

Don't know what your deductable is with Mercury, but if it's $500, I'd rather pay that then the whole amount $800+ installation.

This happened to me. The check was made out to me and the shop. Nothing you can do about it.

Well the first time it was slashed was in Irvine, CA. This time, it was done last night in a gated community garage. My car was not the only one that was hit. There was roughly 10 cars that were broken into. Just sucks cuz i wish I would have stayed with all state. I can post pics if you guys want. The adjuster is also trying to charge me for betterment fees as well because they said that the top they are going to replace it with is a newer top, even though my top was just replaced a couple of months ago. Im pretty sure they are in their full legal right but I feel that we are getting the short end of the stick everytime.

Irvine huh? That's funny. I live there and everything was cool. I'm assuming you were @ UCI, since a lot of hooligans there @ night to scope out the cars. Damn college kids and neighboring Santa Ana ruffians!

it's actually funny that you mentioned "Santa Ana" because this was where it was slashed the 2nd time. I spent a night at my cousin's house and parked it in his gated community garage. Next morning when I woke up at like 5am, I went downstairs to grab a smoke and I saw about 3-4 people looking at their car that was broken in to. I immediately ran to my car and mine was hit too. It must have been a really skinny fella that did it because he was able to fit into a small opening through the top. They ripped out my cd cover and stole my FACELESS DECK! What the hell are you going to do with a faceless deck? Anyhow, you're right on target because my first slashed top situation happened near UCI campus. On top of my top being slashed this time, this guy had the nerve to leave a muddy footprint on my driver side fender! It caused a slight dent in it too! I hope that these bastards rot in hell. Now I have to worry about taking time off of work to drop off the car, etc. *****Sigh****

so is it impossible for me to force my insurance (mercury) to cut me check? It seemed very fishy the way the adjuster was trying to explain the procedures to me. She said that I was able to cash out but the check would be made to the body shop as well. So what the hell does that mean? How can I cash out? It seems like she was trying to word it in a way that forces me to think that i cant get a check to cash.

So let me get this straight, the insurance company says they will pay for all of the damage, but you are upset because they would rather pay the body shop, and not you directly, so now you can't cash the check, go to a different body shop, pay them with the money the insurance company gave you, and pocket the rest?

Are you upset because the insurance company wont let you scam them out of some money?
