But the "many" that you talk about is probably 50-100 out of 20,000 USA built cars....... which is .25%-.50%.... not a very high %. that is like 1 in 200 or 1 in 400 having the problem.
I agree that if Honda worked a deal on reduced or free labor that would be nice on their part.

I'm not sure about the owner being low on oil. He said that checking afterwards showed that his oil level was low. He does not specify when he had previously checked the oil level before the failure. dbrower, can you clarify?
Haven't we seen many other engine failures where Honda diagnosed it as low oil level but the owner swore he had been keeping an eye on it? Is the low oil level a result of the engine failure? Or did the low oil cause the engine failure?

i'm actually inclined to agree with rick here. i don't think the DSM is gonna approve the full cost of replacing your engine. even with the lawyers and all the s2000 internet communities in your back pocket, all honda has to say is that your car was found to be low on oil upon inspection and that is the cause of your engine failure. wheather the low oil condition is the cause or a result of the failure is neither here nor there at this point. it's just my opinion that you should start looking at used engines cause this doesn't look good....
