the unthinkable has happened
Sup s2ki fam,
The unthinkable has happened. I was traveling straight on the right-hand side, headed towards an intersection in my city. As soon as I pass the intersection, a car in the opposing left turn lane, in the middle of the intersection, turns left. Right after he passes, another car in the left turn lane, before the intersection, attempts to turn left over a double yellow line into a convenience store. As soon as he makes that left (>10 yards from me approaching in the opposite direction), he sideswipes my car on the driver's side which causes me to careen into a lightpole at the corner of the intersection. From the initial impact to violent crash, it happened so fast (like two seconds).
To my knowledge, a person in the left turn lane should yield for opposing traffic and be SURE that it's clear before making the turn. Plus, isn't turning over double yellow lines illegal? Nothing confirmed yet, but I'm pretty sure he was at fault. He did get cited at the scene for something though.
I white-out and awake to someone pulling me onto the grass. I'm dazed, with a concussion, few bruises, airbag burn, but other than that, I feel like I'm "ok" (thanks to the seat belt).
Both airbags went off, driver's side front knuckle is torn in half, front end/frame damage. His car only had minor front end damage (headlight, fender, bumper).
Where do I go from here? I have school and work on Monday, so tomorrow is the only chance I have to set things up to become mobile again. That car was my pride and joy. Luckily I avoided major external injury, and did not die. His careless mistake is causing me major financial and transportation headaches.
From my off the top, low-end estimation:
two airbags = 2,000
front end = 1,000
chassis = 1,000
frame = 1,000
paint = 1,000
misc. parts = 1,000
estimated low-end total = 7,000
I have full coverage, and still owe on the car. I would ideally like to rebuild it as it was my first s2000, but I have a feeling it's going to be totaled. Plus, according to forum advice, the frame will never be the same again. Should I start looking for a replacement? Buy it back and part out?
Has anyone ever been in a similar situation? What would you recommend for me to do at this point? What can I expect due to this situation? Sorry for the lengthy post, I just feel super shitty, unsure of what to do right now, and don't know who else to tell this to.
Thank you in advance for any input and advice.

Turning across double painted lines is not legal, however people do it all the time. Fault sounds pretty apparent.
If you actually did black out and have a concussion, you need to be seen by a doctor, preferably the day of the accident for insurance reasons.
I hope you don't go after them for your pride alone. But your accident does sound like it was pretty bad and from experience I know the other persons insurance is going to try and rush you to settle. So, you may want to speak to a insurance claims lawyer.
Go to the doctors though, you should never take head trauma lightly.

The other insurance co. will try to low ball you, you NEED to get a lawyer and I hope you have been seen by a doctor. I had a minor accident back in '88 and I thought I was fine. But my Dad made me go to the doctor and he found that I had two ruptured disks in my back. I still feel the pain today and before to long(when the pain gets to bad) I will need to get them fixed.

Hey man in 2008 I was blind sided by a drunk driver in my s2k hit and run but about the same as your I blacked out to went to doctor and when I thought I was fine I had severe back damage. My s2k was totaled out which was a shame my favorite car of all time. I should have bought another but got a new evo instead now I'm about to buy another s2k for sure. Like others have said get a lawyer I did and it saved me for he was able to track down the driver with police help.

I hate to hear about the car, terrible news.. Glad you're ok though... On the turning across a double yellow line.... it's meh... did he fail to yield right of way? Absolutely so it IS his fault.. but the line is little... people do it all the time... I'll bet most people don't know it's technically illegal to back up on a public road... I had a friend who was cited at fault, bc as he was backing out of his driveway (in a turn) a driver came speeding around the corner and rear ended him... The Officer said it's illegal to back up on a public road... He didn't argue how he was supposed to use his driveway... So there are a lot of silly little laws out there..
As far as going after him for everything he has... I don't believe in that at all... Imagine how you would feel if you were in his shoes (or someone at fault in an accident) ... We all make mistakes.. But imagine you made that mistake, and knew you did wrong.. and were accepting of the consequences (replacing car, taking care of medical bills, etc) and the other driver purposefully went after everything you had.. Now you're going to struggle to survive the rest of your life bc someone wanted to be overly compensated... If he was drunk/high/ etc, I'd say go for more ... but he wasn't (that you mentioned)
I say as much damage as the car has, I would either make sure you get enough money to replace the car, or get additional compensation after repairs for the degradation in value he caused.. past that, ask for enough to pay your medical expenses, any time you have to take from work, rental expenses, etc ... and then maybe enough for a nice set of wheels for the next s2k or something...
Don't get greedy with it, Karma likes to bite people in the ass... Just my .02
Hope all works out well for you and you don't have any lasting injuries... (I live with a prior fractured vertebra... and it sucks)
