Default What is the standard protocol ?

Long story short. I ordered an exhaust, it came damaged. Vendor said they packed it and it was o.k. Basically there's a dent in the can. I contacted them and they said in pretty simple terms. File a claim w. UPS and when they issue payment they will send me a new exhaust.

Shouldn't It work this way ?

I return the exhaust. They ship me a new one and they put in a claim with UPS ? They basically take the hit for the 2months it will take for the claim to be completed ??

Tell me about it. I just had another issue with UPS. It took 3 months to get the claim and that's when UPS even acknowledged they had no idea where the package was.

once it leaves the seller its your responsibility

you COULD have gotten it from them direct but due to distance YOU chose to have it shipped.

ergo, YOU the owner of the item while it was damaged should place a claim.. the fact they take a long time isnt something u can change

sorry for inconvienence..

only thing i can say is.. have pics/documentation.. take pics when person comes and take a copy of the form he fills out.

put exhaust on and then when they issue a check, sell the old exhaust and buy new.. technically the damaged one is YOUR property so look at it as a good thing now you'll have two given you'll sell the one for less than retail because of damage.. but thats more than you had before.

Shouldn't be - that may be the way it is on eBay but that is not typical business practice. The person that gets the package can't prove how it was packaged and did not pay the shipping and therefore they are not insured. The shipper is the one who is insured and is the one that has to file the claim. Quote from UPS's site: "If your package was damaged in transit, report the damage. If the damage is confirmed by UPS, the shipper can file a claim for the rep". Personally I would contact the seller again and let them know that if they can't resolve the problem that you'll dispute the charges with your CC company.

Where was this purchased from - that may help determine what the seller is responsible for.

I don't want to disclose the vendors name as to not come across as starting a bashing thread but they are a shop, not just an individual running a group buy or in the private for sale.

I agree w. the post above regarding the exhaust being my property, but in the same respect, I work for a manufacturer and if something is damaged upon reciept I send a new and file the claim.

I heard back from the vendor and they still want to file the claim. They told me that it would be no longer then two weeks. Obviously they have no experience w. UPS.

Taking rijowysock's advice I also told them if I have to wait for this process then i'm keeping the exhaust and I want the full refund that UPS will pay out.

you as the reciever cannot file a claim. only the shipper is able to do this and the standard UPS procedure is:

1. sender files a claim
2. claim rep. comes out and inspects the item and packaging or requests a pick up tag for inspection.
3. once inspection is complete, item will be returned to sender or UPS will take control of the item.
4. refund check is sent to sender or a denial letter

either way, its not your responsibility, it's the shipper and you should send it back. one more thing, the item has to be insured of course so if you didn't pay extra to insure it and the sender doesn't insure items if not reimburse you'll only get a $100 check

how do i know all of this BS? my bro owns a UPS STORE and i'm in the process of taking over one

lol i work for fedex.... and let me tell ya, i probably wouldnt ship using fedex. actually i bet that most shipping companies do the same stuff. so its best to just buy it locally.

anyways, i do believe that the buyer has responsiblity to file the claim because once it leaves the sellers, they dont own the item anymore. also insurance is your best friend
