Interesting perspective but nope, not correct.

C4SxM5 has it right.

The shipping company has a contract with the shipper, not the receiver. As much as it sucks, the shipper has to file claim and they are even the ones that get reimbursed. Most companies will let you return the item to them once UPS/Fedex has come to the receiver's place to inspect the package.

Whoever paid the shipping company is the one who has to do all the legwork.

Bad business on the vendor in this situation - they should have taken the exhaust back and shipped a new one to you without making you go through all this
