A particular user here sold me an item off of his car.

He told me that the item was going to be taken off last monday.

He was paid last week and it should have shipped when he got his money

He e-mails me this Sunday saying that his other car is down and because of it, he cannot take said item off of his car. Even though he still has the stock item to replace the part?

What should I do? I have already paid this person in full, and they are continuing to use and put miles on something that belongs to me now?

I would get him on the phone and talk to him instead of emailing. It will be much easier to exchange your points of views. This way you can avoid the situation from getting ugly and out-of-hand.

that sucks! even though sometimes people cannot control other factors like other cars breaking down, it should be taken into account when receiving money for a purchase. for example, in the web world, when I am to charge someone for a job, if I dont get it done in time, I take that off of my fees - I am still working just as hard if not harder due to unforseen complications.

It should be looked at the same way with car parts - if someone promises you a particular part in a given amount of time and refuses to give you the part due to complications of his own then you should either take all the money back / have him reverse the charges, or let him know that he needs to find alternative ways to remove the part you purchased.

This person has the means.

But it isn't like his s2k broke, and he has the stock part to replace my part. And he has made no attempt to give me an updated date as when I can expect it.

What upsets me is he continues to drive w/, put miles on, and use a part that isn't his any more.

Maybe a phone call is in order.

If he doesnt respond, then his email address (if you can supply that) and his phone number will be posted to all sorts of news groups for the crawlers to grab a hold of. And I'll make sure that the damned Austin American Statesman gives him a call too. They still give me a call every other day - even though I once subscribed to the paper just so they wouldn't call me anymore!

As a person who sells stuff on ebay, I am noticing the stuff I ship to people is taking a lot longer to get to people because it's a holiday season. I would suggest you wait another week and then complain.
