It's a fender... one of the cheaper body parts. If you want the car, then replace them. TBH they really don't look that bad considering it's definitely a roadster look. Not that I'd spend my money on them, but I wouldn't think twice about them if I liked the rest of the car.
As far as the color change, it looks like a bad case of a bad camera / glare. The front end pic you can see the a bit of the top of the fenders and they look to color match.

I have to disagree with some of the people above. The fenders ARE a deal breaker, for me, because they exemplify the owner's approach to modifying and caring for the car. If they put on Z3 fenders, what else did they do to the car that you cannot see?
Some people like the fenders and some don't, but I am not surprised to see fenders like these on any cars.
If the car is in good shape, and any previous damages have been properly repaired, then the fenders would not be the deal breake for me. This car only has 13,000 miles on it and mechanically it should be in decent shape. I wonder what kind of damage this car had. Something like vandalism should not affect the car's mechanics too significantly.
I've seen cars being totalled just because the interior was urinated and defecated on by a puppy.
