Your Opinion PLEASE
I think somebody has used a picture off my website and put it on their own as their product. The picture is at http://www.invisabra.com/products.htm and mine is at http://www202.pair.com/snizzle/stongardgeo...com/gallery.htm Scroll down the the second Accord picture and tell me if you think it is the same picture.
If it is the same picture, what can I do? I don't mind the use of the photo as much as I mind somebody calling OUR product THEIR product. Isn't that illegal? I know that the car pictured on my site is StonGard since its my moms car!!!

Yep, I agree... that's your pic! I hope a lawyer on the board can step up to the plate and comment on it. Until then, I'd do a search and find any website or board where info on this has been posted and expose it!
I see that "invisibra" is made by 3M. Isn't stone guard (sp) also made by them? It's probably the same product under two different names.
I'd also have to say that a silver accord is hardly distinctive. It's one of the top 5 selling cars in this country. I imagine there is more than one with stone guard or invisibra or whatever.

David, if that's not the same picture, it's one HELL of a coincidence!
I would tell the guy to remove the picture as it is not his property...
If he doesn't, I don't know what your recourse is, but tell him that he must remove the picture!!

I am no IP lawyer (but I play one on TV), but seriously folks.....
I doubt that you can really force him to take it off. Whats posted on the web, unless clearly proprietary or trademarked, is usually open for public consumption and use. I haven't looked, but do you have something claiming rights to your website and everything on it? That might bolster your case a bit, but in general, if its on the web and not protected, its likely free game. We have about 30 IP lawyers in my firm who spend their days doing nothing but protecting our clients websites, I'll bounce it off one of them.

Thanks everyone. I have sent them an email and asked them to remove the picture if it was mine( I am nearly 100% certain after painstakingly comparing all the highlights and shadows ). I guess they didn't have any good shots of their stuff at the time so I guess I should feel flattered.
They are the same. I can see the same stain image on the top left corner and a line going across both pics. I think they have to change a certain percentage or something like that to use it.
